The new Tenant Deposit Scheme has been designed to protect tenants from unscrupulous practice concerning the holding and return of deposits. The legislation, which is part of the Housing Act 2004 and stems from the office of Deputy Prime Minister John Prescott, is currently going through Parliament and will apply to all assured short-hold tenancies that begin on or after the implementation date, as well as to all tenancies renewed after that date.
Staff at changing-home are being fully trained by experts on the implications of the Tenant Deposit Scheme, which aims to provide security for deposits and speedy dispute resolution in those cases where agreement cannot be reached between landlord and tenant at the end of the tenancy.

The MORI findings were consistent with Government figures showing that one in five private tenants have problems with deposits being unreasonably withheld at the end of a tenancy. There are 2.2 million private tenants, 70 per cent of whom have paid a deposit averaging £510.
The tenancy process begins with the tenant paying the deposit to the lettings agent. It is held intact until the checkout of the property is complete and a proposal for the settlement has been agreed with both the landlord and the tenant. If agreement is reached, the agent will distribute the money, but if there is disagreement the dispute will be sent to the Tenancy Deposit Scheme for Regulated Agents (TDSRA) for adjudication.
TDSRA is run by the Dispute Service, which charges member firms an annual subscription, equivalent to £6 per office per week. The agent collects this money and pays the TDRSA on an annual basis.
